PRIVACY POLICY AND TERMS OF USE
CIMET SCIENTIFIC CORPORATION SAPI DE C.V. (hereinafter referred to as “Cimet” or the “Recipient”), with address located at Sierra Nevada 850, Colonia Independencia, C.P. 44340, Guadalajara, Jalisco. (the “the Recipients Address”), is responsible for the processing, use and protection of your personal data in accordance with the Mexican legislation (Ley Federal de Protección de Datos Personales en Posesión de Particulares) (the “Law”). In compliance with such Law, Cimet makes available its privacy policies, which adhere to all Mexican regulations related to personal data.
For what purposes will Cimet use your personal data?
All personal data gathered by Cimet will be solely used for the following purposes, which are necessary to provide the best possible service:
a) Provide personalized experiences when browsing and interacting with our website; and to
b) Generate databases that will be used for commercial, advertising and promotional purposes.
Additionally, Cimet may use your personal data to promote other Cimet products or services, as well as for statistical and marketing purposes. In the event you do not want your personal data to be processed for this additional purpose, you are entitled to notify your disapproval within the next 5 five days after acknowledging the present privacy policies, notice you may send to the following email address: contacto@cimetscientific.com. What personal data does Cimet collect and use?
In order to provide our services and carry out the purpose described in our Privacy Policies, Cimet may gather the following personal data:
a) Data related with users’ identification and contact information, such as: full name or company name; e-mail, telephone, and home address.
Personal data is collected remotely on Cimets’ website or via email.
All personal data collected by Cimet will be processed in accordance with the following principles: (i) legality; (ii) consent; (iii) loyalty; (iv) quality; (vi) purpose; (vii) proportionality; and (viii) responsibility in compliance with the law.
What sensitive personal data does Cimet use?
Cimet, in accordance with the provisions of article 3 section VI of the Law, does not collect personal data of a sensitive nature from its users.
With whom do we share your information and for what purposes?
Your personal data is shared within the country (Mexico) with the corresponding organizations and authorities other than Cimet.
The authorities do not require the express consent of the owner of the personal data; the foregoing based on article 10 section IV and article 37 section IV of the Law, by virtue of the fact that they are given through a contract concluded by the person responsible and a third party in the interest and benefit of the owner and with governmental authorities for the fulfillment of obligations established in the applicable legislation.
All transfers listed will be made in accordance with Cimets’ privacy policies and the recipient will be bound on the same terms.
If you do not express your express refusal to make such transfers, it will be understood that you have given your consent to Cimet to make such transfers. The refusal mentioned in this paragraph must be expressed to the email address contacto@cimetscientific.com and must be accompanied by all identification information needed.
Except for that specified above, your personal data will not be transferred, unless mandated by authority or court order, by prior order legally issued by the corresponding administrative or judicial authorities.
How can you access, amend, or cancel the use of your personal data?
Regarding the information that Cimet collects, you have the following rights of Access, Amend, Cancellation and/or Opposition (“ARCO Rights“):
(i) Access: Allows you to know what personal data is being collected by Cimet, the use we give such information and how we process your personal data. In order to exercise such right you must prove your personality, proving the requested information.
(ii) Amendment: Allows you to request the amendment of your personal information, in case such information is outdated, inaccurate or incomplete. In order to exercise such right you must prove your personality, proving the requested information.
(iii) Cancellation: Allows you to request the elimination form our database of all your personal data. In order to exercise such right you must prove your personality, proving the requested information.
Cimet will not be obliged to cancel personal data regarding the situations stablished on article 26 of the Law.
(iiii) Object: Allows you to object the use of your personal data for specific purposes.
In the event that you exercise your cancellation rights, the Recipient will block the use of your personal data, by virtue of the fact that such information is necessary to comply with the assumptions established in article 25 of the Law, once the blocking period has elapsed, Cimet will delete the personal data subject to the cancellation request.
To exercise any of the ARCO Rights, you may contact Cimet at the following email: contacto@cimetscientific.com, which will process requests for the exercise of these rights and will answer any questions you may have regarding the processing of your personal data.
The request to exercise an ARCO Rights must be accompanied by the following, in accordance with article 29 of the Law:
(i) name and address or other means to communicate the response to your request; (ii) documents proving the identity or, where appropriate, the legal representation of the holder; (iii) the clear and precise description of the personal data to exercise any of the aforementioned rights; and (iv) any other element or document that facilitates the location of your personal data.
If this procedure is carried out by a third party, it is necessary to accompany documents that prove your representation and personality.
Once the request has been processed, Cimet will communicate its resolution within a maximum period of 20 (twenty) days.
Cimet may deny access to your personal data, or the amendment, cancelation or opposition o such personal data, in terms of article 34 of the law.
The procedure for the exercise of ARCO rights will not generate any cost to the owner, unless the same person reiterated his request in a period of less than twelve months, the foregoing based on article 35 of the Law.
How to withdraw your consent?
You can withdraw the consent you have granted Cimet for the processing of your personal data. However, it is important that you notice, in doing so, Cimet may not be able to meet your request or terminate the use of your personal data immediately, since it is possible that due to some legal obligations, Cimet will require to continue processing your personal data. The withdrawal of your consent will not have retroactive effects.
Likewise, it is important to consider that, for certain purposes, withdrawing your consent will imply that we can no longer continue to provide the requested service, therefore terminating your relations with us.

The exercise of any ARCO Rights and/or the withdrawal of your consent will not generate any cost.
How can you limit the use or disclosure of your personal information?
The following mechanisms will help you limit the use or disclosure of you personal information:
1. Your registry at the public registry to avoid advertising, in charge of the Procuraduría Federal del Consumidor (“PROFECO”), so that your personal data is not used to receive advertising of any type. For more information about this registration, you can consult the PROFECO Internet portal.
